General Terms and Conditions of Silver Circle
hereinafter also referred to as the “company”, “entrepreneur”, “Silver Circle”, “we”, “us” or similar customary terms.

§1 Scope with respect to entrepreneurs and definitions

(1) The following General Terms and Conditions apply to all deliveries via our online shop between us and a consumer in the version valid at the time of the order.

A consumer is any natural person who enters into a legal transaction for purposes that predominantly are outside his or her trade, business or profession (§ 13 BGB – German Civil Code).

§2 Conclusion of contract, storage of contract text

(1) The following provisions on the conclusion of the contract apply to orders placed via our online shop at http://www.silvercircle.de, including possible technical variants such as “https://”.

(3) The presentation of goods in our online shop does not constitute a legally binding offer on our part, but is a non-binding invitation to the consumer to order goods. By ordering the desired goods, the consumer submits a binding offer to enter into a purchase contract.
(4) When an order is received in our online shop, the following rules apply: The consumer submits a binding contractual offer by successfully completing the order process provided in our online shop.

The order is placed in the following steps:

Before submitting the binding order, the consumer can return to the page on which the customer’s details are recorded and correct input errors by using the “Back” button in the internet browser used, after checking his or her details, or cancel the order process by closing the internet browser. We confirm receipt of the order immediately by means of an automatically generated email (“order confirmation”). With this email we accept your offer. If the order is placed by a method other than the online procedure, the customer will receive an electronic confirmation message of receipt analogous to the above, provided that a valid email address was given when placing the order.

(5) Storage of the contract text for orders via our online shop: We store the contract text and send you the order data and our Terms and Conditions by email. You can also view the Terms and Conditions at any time at https://silver-circle-gmbh.myshopify.com/policies/terms-of-service. You can view your past orders in our customer area under My Account --> My Orders.

§3 Prices, shipping costs, payment, due date

(1) The stated prices include statutory VAT and other price components. Any shipping costs are added to this.

(2) The consumer has the option of payment in advance (bank transfer), PayPal, credit card (Visa, Mastercard, American Express), invoice (Klarna).

(3) If the consumer has chosen payment in advance, he or she undertakes to pay the purchase price immediately after conclusion of the contract.

§4 Delivery time

(1) Unless otherwise clearly stated in the product description, all items we offer are ready for dispatch immediately. Handover to the shipping service provider will take place no later than within 5 working days. Delivery (arrival at the customer’s address) will take place within 2–5 days. The delivery period begins, in the case of payment in advance, on the day after the payment order is issued to the bank carrying out the transfer, and for all other payment methods on the day after conclusion of the contract. If the end of the period falls on a Saturday, Sunday or public holiday at the place of delivery, the period ends on the next working day.

(2) Upon handover of the goods to the customer or to a third party commissioned by the customer, the risk of accidental loss and accidental deterioration of the goods passes to the customer. If the customer is in default of acceptance, this is deemed equivalent to handover.

 

§5 Retention of title

The delivered goods remain our property until all claims against the customer have been paid in full.

Consumers have a right of withdrawal in accordance with the following provisions, whereby a consumer is any natural person who enters into a legal transaction for purposes that predominantly are outside his or her trade, business or profession:

The customer generally has a right of withdrawal in accordance with the cancellation policy set out below. The right of withdrawal exists only for consumers. The right of withdrawal does not apply to (a) items that are not prefabricated and for whose manufacture an individual selection or determination by the consumer is decisive, or which are clearly tailored to the personal needs of the consumer, or (b) items that are liable to deteriorate rapidly or whose expiry date would be quickly exceeded, or (c) sealed goods which are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery. If you exercise your right of withdrawal, you must bear the direct costs of returning the goods if the delivered goods correspond to those ordered. Otherwise, the return is free of charge for you.

Cancellation policy

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the last of the goods.
To exercise your right of withdrawal, you must inform us

of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post, fax or email). You may use the model withdrawal form provided at https://www.silvercircle.de/policies/refund-policy, which is, however, not mandatory. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of withdrawal

If you withdraw from this contract, we must reimburse you for all payments we have received from you, including delivery costs (with the exception of any additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we received notification of your withdrawal from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees for this repayment.
We may withhold reimbursement until we have received the goods back or until you have supplied evidence that you have sent back the goods, whichever is the earlier. You must send back or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you inform us of your withdrawal from this contract, at the following address:

The deadline is met if you dispatch the goods before the period of fourteen days has expired. You will bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
